Your executor (or executors) plays a key role in helping to organise and manage your estate, by bringing together all administrative aspects and finalising the financial matters in Belgium.

This tends to be a significant undertaking involving tasks including closing bank accounts, dealing with any pensions, paying necessary taxes and selling or transferring investments or property.

You will need to choose your executors when you write your Will and unless you have a trust corporation involved, it’s wise to ensure that they are younger than you or that you appoint potential replacements. Acting as an executor is a significant responsibility and can be especially challenging if you choose a family member or friend who has a close or emotional relationship with you.

Therefore, it’s important to carefully consider who you want to act on your behalf when the time comes. While many might feel they have the skills needed to carry out executor duties, it can be a complex process, and even the most capable individuals may need help and guidance. What is a professional Executor?

A professional Executor has the required skills and experience to deal with your estate, ranging from handling the deceased’s tax affairs, selling or transferring their property, and managing their investment portfolio.

What does the Executor of a will do?

The Executor of a Will ensures all property owned by the deceased party is secure as soon as possible following their passing. This individual has a legal responsibility to identify all assets in the estate, obtain valuations, settle any tax due and, if necessary, make an application for the Grant of Probate. The Executor will also be responsible for paying any outstanding debts and liabilities and making distributions to the chosen beneficiaries according to the terms of the deceased’s Will.

How many Executors can I appoint?

You can appoint as many Executors as you like in your Will, and you can also choose substitute Executors should any of your initial choices be unable or unwilling to act. However, the maximum number of people that can act as Executor at any one time is four.

What power does an Executor of a Will have?

Some of an Executor’s powers are standard, given under state legislation, whilst others may be granted in the Will. Traditional Executor powers include:
